MojApp Beta Terms of Use

MojApp is an online listings and marketplace platform that helps users discover and review real estate and vehicle listings, primarily in Montenegro, and publish listings when the relevant features are available.

Listings may be published by users, professional advertisers, or the MojApp team where the necessary authorization has been obtained.

Unless expressly stated otherwise, MojApp is not a party to any sale, rental, lease, or other transaction between an advertiser and a person responding to a listing.

MojApp does not operate as: • a real estate agency, • a vehicle dealership, • a bank or credit institution, • an insurance company, • a notary, • a law firm, or • an inspection or valuation organization.

Content available on the platform does not constitute legal, financial, tax, or investment advice.

MojApp is under active development.

During the beta period: • some features may be incomplete or experimental, • the interface and functionality may change, • certain account or listing management features may be temporarily unavailable, • technical errors or interruptions may occur, and • certain features may be made available only to selected users for testing purposes.

MojApp does not guarantee the continuous availability of any particular feature, function, or level of service.

Beta status does not remove any mandatory rights users have under applicable law.

When creating an account on MojApp, you must ensure that the information you provide is accurate and up to date.

You are responsible for keeping your account secure and preventing unauthorized persons from using your login credentials.

Impersonating another person or business, using misleading identity information, or misusing your account is prohibited.

You may use MojApp and its listing features only if you have the legal capacity required under the laws applicable where you are located.

Access to an account may be restricted temporarily or permanently in cases of suspicious use, fraud risk, a security breach, or a serious violation of these Terms.

When you submit a listing, photograph, description, or other content to MojApp, you confirm that you have the rights and authority necessary to publish it.

Advertisers must, in particular, keep the following information accurate and as up to date as reasonably possible: • price, • location, • ownership or authority to sell or rent, • vehicle or property characteristics, • listing status, and • availability.

You may not use another person’s photographs, text, personal data, or intellectual property without permission.

You retain ownership of your content.

By submitting content to MojApp, you grant MojApp the rights to host, display, reproduce, and distribute it to the technical extent necessary to operate the service and display the content on the platform.

You may not use MojApp to:

MojApp may review, restrict the visibility of, or remove content that it believes violates the law or these Terms.

• publish false or knowingly misleading listings,
• commit or facilitate fraud,
• use stolen content or photographs without permission,
• impersonate another person or business,
• offer illegal goods or services,
• publish personal data unlawfully,
• share harassment, threats, or unlawful hateful content,
• distribute malicious software,
• attempt to bypass the platform’s security mechanisms,
• disrupt the system with automated requests or spam,
• systematically or collectively extract data without MojApp’s express written permission,
• unlawfully collect other users’ contact details,
• infringe intellectual property rights, or
• claim professional authority, representation, or business status that you do not actually hold.

MojApp does not independently verify all information contained in listings.

You must carry out the necessary checks before making a payment, sending a deposit, or signing a contract in relation to any property or vehicle.

Depending on the circumstances, the following should be independently verified: • identity, • ownership, • title deeds or registration records, • vehicle documents, • authority to sell or rent, • physical condition, and • legal status. Where necessary, assistance should be obtained from a notary, lawyer, inspector, appraiser, or other qualified professional.

MojApp does not guarantee an advertiser’s identity, the condition or status of the advertised asset, or the successful completion of any transaction.

Real estate agencies, agents, vehicle dealerships, and other professional users may appear on the platform through a professional profile or account.

Professional users are responsible for their own statements, listings, and services, and for complying with the professional, advertising, and consumer laws and regulations applicable to them.

Unless expressly stated otherwise, an account or profile displayed as verified by MojApp does not constitute a guarantee regarding the person’s professional license, service quality, or transactions.

During the beta period, MojApp’s standard user features may be provided free of charge.

If no paid listing package, subscription, or self-service payment option is currently available for users to purchase directly through the platform, users will not be charged automatically for those features.

In the future, MojApp may offer paid services such as: • premium listings, • promoted placement, • professional packages, • subscriptions, and • advertising.

Before paid services are made available, the relevant pricing, payment, renewal, cancellation, and, where applicable, refund terms will be separately disclosed to users.

MojApp may use third-party services to provide certain features.

These may include, for example: • mapping services, • authentication, • email services, • image storage, and • analytics and technical infrastructure.

Links to third-party websites may be provided for information or convenience.

MojApp is not responsible for third parties’ own services or content. Those services may be subject to the relevant provider’s own terms and privacy policy.

MojApp may review content and accounts to help maintain the security of the platform and reduce misuse.

MojApp may: • reject a listing, • temporarily hide a listing, • reduce the visibility of content, • remove content, • restrict account features, or • suspend or close an account.

These measures may be applied in particular where fraud is suspected, there is a security risk, the platform is used unlawfully, or these Terms are violated.

You may report suspicious content or security concerns to MojApp.

MojApp aims to keep the service as accessible as reasonably possible but does not guarantee uninterrupted or error-free operation.

The service may be temporarily unavailable due to maintenance, infrastructure issues, interruption of a third-party service, a security incident, or a software error.

MojApp may change the platform, its features, and these Terms from time to time.

Where appropriate, MojApp aims to notify users of material changes.

MojApp provides the service as it is available.

MojApp does not guarantee that listings published by users will always be accurate, complete, current, or fit for a particular purpose.

MojApp is not a party to, or guarantor of: • disputes between users, • users’ conduct, • the condition of an advertised property or vehicle, • third-party services, or • transactions carried out between users.

Nothing in this section removes any consumer or other statutory rights that cannot be limited or excluded under applicable law.

You may stop using MojApp at any time.

You may submit requests concerning account closure or your personal data through MojApp’s contact channels.

When an account is closed, related content may be removed, anonymized, or retained for specified periods in accordance with applicable law and the Privacy Notice.

Use of MojApp is subject to applicable laws and regulations.

Nothing in these Terms removes any consumer rights or other mandatory statutory rights that apply in the place where the user is located.
